Terms of Use.

These terms apply when you use ausbrokers.au and buy an appraisal. They're written in plain English. If anything here is unclear, email hello@ausbrokers.au.
1. Who we are
ausbrokers.au is operated by AUS Brokers Pty Ltd (ABN 13 702 650 913, ACN 702 650 913) ("AUS Brokers", "we", "us"). You can contact us at hello@ausbrokers.au.
2. What the service is, and what it isn't
AUS Brokers prepares an indicative appraisal of a business, and optionally a buyer-ready business profile and a draft listing ad, from the information and documents you give us, published industry sale multiples, and businesses currently listed for sale.
- It is an appraisal, not a valuation. It isn't prepared by a registered valuer and isn't suitable for finance, tax, family law, court or insurance purposes. If you need one of those, engage a qualified valuer.
- It isn't financial, legal, tax or accounting advice. Speak to your own advisers before you make decisions.
- We don't act for you or for any buyer. We're not your business broker or agent, we don't market or negotiate your sale, and we're not involved in any transaction.
- No price is guaranteed. What a business sells for depends on the market, the buyer and many things we can't see. Your appraisal is one input to your decision, not a promise.
3. How appraisals are prepared
Appraisals are prepared with the help of artificial intelligence (Claude, by Anthropic), which reads your documents and drafts the analysis. The appraisal's price range is calculated from industry sale multiples applied to the business's earnings. Comparable businesses come from public for-sale listings; asking prices aren't sale prices, and listings can be out of date.
AI can make mistakes, and your appraisal is only as good as the information you provide. Read your reports carefully and check the figures before relying on or sharing them.
4. Your account
You sign in with a link emailed to you, so keep your email account secure: anyone who can read your email can sign in as you. You must be 18 or over and entitled to deal with the business you ask us to appraise.
5. What you give us
- You confirm the information and documents you upload are yours to share, and are accurate to the best of your knowledge.
- Documents such as staff rosters can contain other people's personal information. Where you can, remove names and contact details before uploading. We design our reports to leave out staff names and contact details, but you remain responsible for what you upload.
- Don't upload anything unlawful, or anything you don't need to.
6. Paying
Prices are shown before you pay and are in Australian dollars. Payment is taken by our payment provider, Stripe, before your appraisal is prepared; we never see or store your card details. See our Refund Policy for what happens if something goes wrong.
- Adding the Buyer Profile later: if you bought the Appraisal on its own, you can add the Buyer Profile (and the draft listing ad) to it at any time while it's in your account, paying only the difference in price.
- One free re-run: within 7 days of paying (or if your appraisal didn't finish), you can run the appraisal of the same business once more at no charge, for example with extra documents. As we delete documents after every appraisal, you'll need to upload them again.
- Victorian listing credit: if your business is in Victoria and you list it with our related business Vic Brokers within 90 days of your appraisal, the amount you paid for the appraisal is credited back to you. The credit is provided by Vic Brokers under its own agreement with you. We only pass your details to Vic Brokers if you ask us to.
7. Your reports
- You may use, print and share your reports for the purpose of selling or understanding your business.
- You can edit the wording of your reports and add photos. You're responsible for your edits and for anything you publish or send to buyers, including the contact details you choose to show in the buyer profile.
- Don't present a report as a formal valuation, or as AUS Brokers's endorsement of the business or its figures.
- The design of the reports and this website belongs to us; the facts and documents you supplied remain yours.
8. How long we keep things
The contents of the documents you upload are deleted as soon as your appraisal is finished (or if it fails or is cancelled), and within 24 hours if you don't complete payment. Your finished appraisal is kept in your account for 12 months so you can download it again, then deleted. Details are in our Privacy Policy.
9. Our responsibility to you
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law that can't lawfully be excluded, including the consumer guarantees.
To the extent the law allows: our liability to you for anything to do with the service is limited to supplying the appraisal again or refunding what you paid for it; and we aren't liable for indirect or consequential loss, including loss of profit or a lower sale price, or for decisions you or others make based on a report.
10. Fair use
Don't misuse the service: for example, don't try to access other people's appraisals, interfere with the website, or use it to appraise businesses you have no connection with in order to mislead anyone. We may suspend accounts that do.
11. Changes
We may update these terms. The version that applies to an appraisal is the one on this page when you paid for it.
12. Law
These terms are governed by the law of Victoria, Australia, and you and we submit to the courts of Victoria.
